What You’ll Need To Consider When Creating A New Will

As you think about preparing to give instructions regarding your new will, here are some pointers that will hopefully be useful for you.

Click on the different information categories you’ll need to provide to learn more about what you’ll need to consider during the creation of your new will and estate plan.

Who will you appoint as your executors?

Ideally, nominate two people (or more) who would be willing to be your executors (to administer your will, sort out the estate and distribute your gifts and so on). Bring along the names and addresses of your nominated executors.

Your Assets

Please list any assets, bank accounts, and other special items that you want to gift to people, charities, or other causes.

Your Beneficiaries

Please list the people, charities, or other causes – if it’s people, their relationship to you (son, daughter, niece, nephew etc) and their current address.

Your Special Items

If you have any special items such as jewellery, collectables, artwork, books and so on that you would like to gift to particular people, take a photograph of the item and bring these along, or email them to us, so that we can create a list to attach to your will, complete with photographs.

This is an excellent way of ensuring that the special someone that you want something specific to go to, receives the specific item according to your wishes.

Your Superannuation

This is a good time to ensure that your binding death nomination for your Super fund is up to date, if that applies to you. Also, if you have details of your Superannuation, then that could be clarified in your will.

You have two options regarding your Superannuation Binding Death Nomination:  either to make the Binding Death Nomination in favour of your children, or in favour of your personal representative.

If it is made out to your children, then your Superannuation will completely avoid your will and be dealt with by the Superannuation Fund Trustee in accordance with your nomination.

If, on the other hand, you make the nomination in favour of your personal representative the Superannuation payment will be made to the Estate and dealt with according to your will.

Your Funeral Wishes

You can include your wishes for your funeral, whether you wish to be cremated and if so where you would like your ashes to be scattered. This is optional. You do not have to include funeral wishes – if you would like to, then your will is a good place to voice your preferences.

Anything Else You Would Like To Include

Your will is exactly that – yours! You can include your intentions for distributing your financial and other assets, as you wish. So, is there anything else that you wish you include, anyone else you wish to donate something to?

Is there anyone you would like to exclude?

Relationships and families can be complex. Sometimes there is a person or persons that for your own reasons you do not want to include, such as an ex-partner.

Please note that while your will is there to state your wishes, in some circumstances claims can lawfully be made to challenge a will and there are circumstances where your wishes may be overturned by a court to provide for someone that the court deems has a real claim.

If there is someone you wish to exclude, your will must state your reason(s) so that in the event of a challenge, your voice can still be heard.

When Will I Need To Update My Will?

If any of the following circumstances happen, then you must make an appointment with Anumis Legal to update your will:

You change your name

Z

A person named as a beneficiary in your will dies

Z

Anyone mentioned in your will changes their name

Z

You sell any property you have specifically referred to in your will, or such property changes its nature

Z

You marry, or enter into a Registered Relationship, pursuant to the Registered Relationship Act 2011, after the date of making your will. This has the effect of revoking your will by law, unless you have expressly stated in your will that your will is made in contemplation of marriage or the registration of your civil partnership.

Z

Your family situation changes. For example:

    • by divorce proceedings; or
    • if you adopt or you have additional children who you wish to include as beneficiaries in your will; or
    • the dissolution or annulment of a marriage which can revoke dispositions to a spouse and revoke appointment of a spouse as executor or trustee

After our initial meeting, you will receive a draft will to approve.

We will make any changes you ask for. 

Z

You can then leave the Original Will with us for secure storage, and we will send you a pdf copy, or you can take a hard copy of your will with you. You can hold on to your original will if you choose to.

Z

If you hold on to your original will, you must be very careful not to mark or staple the Original in any way at all. Keep your original will in a safe, dry place where it can be found in perfect condition by your executor(s) who will need to apply for probate in the event of your passing.
